Welcome to SwingTrail. These Terms of Service govern your use of the SwingTrail mobile application. By downloading, installing, or using SwingTrail, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using SwingTrail, you confirm that you:
- •Are at least 13 years of age (or the minimum age required in your jurisdiction)
- •Have the legal capacity to enter into these Terms
- •Agree to comply with all applicable laws and regulations
If you do not agree to these Terms, please do not use the App.
2. Description of Service
SwingTrail is a video editing application that creates cinematic motion trail effects on sports videos. The App allows you to:

Import or record video clips
- •
Trim and select video segments
- •
Generate motion trail visual effects
- •
Customize effect settings (speed, style, duration)
- •
Export and share processed videos
3. Subscriptions & Payments
3.1 Free and Premium Features
Free Tier:
Full access to core features with a watermark on exported videos
Premium Subscription:
Watermark-free exports and access to all features
3.2 Subscription Terms
- •Subscriptions are billed through your Apple App Store account
- •Payment is charged at confirmation of purchase
- •Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- •You can manage and cancel subscriptions in your App Store account settings
3.3 Refunds
Refunds are handled by Apple according to their App Store refund policies. We do not process refunds directly.
4. User Content
4.1 Your Content
You retain all ownership rights to the videos and content you import into SwingTrail. We do not claim ownership of your User Content.
4.2 License Grant
By using SwingTrail, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing the App's video editing functionality. This processing occurs locally on your device.
4.3 Content Responsibility
You are solely responsible for:
- •Ensuring you have the right to use any content you import
- •The legality of your User Content
- •Any consequences of sharing or publishing your processed videos
4.4 Prohibited Content
You agree not to use SwingTrail to process or distribute content that:
- ✗Infringes on intellectual property rights
- ✗Contains illegal material
- ✗Depicts minors inappropriately
- ✗Promotes violence or hatred
- ✗Violates any applicable laws
5. Acceptable Use
You agree to use SwingTrail only for lawful purposes. You shall not:
- ✗Reverse engineer, decompile, or disassemble the App
- ✗Attempt to gain unauthorized access to any systems or networks
- ✗Use the App to transmit malware or harmful code
- ✗Interfere with or disrupt the App's functionality
- ✗Use automated systems to access the App
- ✗Misrepresent your identity or affiliation
- ✗Violate any applicable local, state, national, or international laws
6. Intellectual Property
6.1 Our Rights
SwingTrail, including its design, features, code, graphics, and trademarks, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except as necessary to use the App.
6.2 Feedback
If you provide suggestions, ideas, or feedback about SwingTrail, you grant us the right to use such feedback without restriction or compensation.
7. Third-Party Services
SwingTrail may integrate with third-party services for functionality such as payment processing (via Apple App Store and RevenueCat) and video analysis APIs. Your use of these services is subject to their respective terms and privacy policies.
8. Disclaimers
8.1 "As Is" Provision
SwingTrail is provided "as is" and "as available" without warranties of any kind, including:
- •Merchantability or fitness for a particular purpose
- •Non-infringement
- •Accuracy or reliability of results
8.2 No Professional Advice
SwingTrail is a video editing tool for visual effects only. It does not provide sports coaching, training analysis, or professional athletic advice. The motion trail effects are for entertainment and content creation purposes.
8.3 Service Availability
We do not guarantee that the App will be available at all times or that it will be error-free. We may modify, suspend, or discontinue the App at any time without notice.
9. Limitation of Liability
To the maximum extent permitted by law:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages

Our total liability shall not exceed the amount you paid for SwingTrail subscriptions in the 12 months preceding the claim

We are not liable for any loss of data, videos, or content
10. Indemnification
You agree to indemnify and hold harmless SwingTrail and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- •Your use of the App
- •Your violation of these Terms
- •Your violation of any third-party rights
- •Your User Content
11. Termination
By You
You may stop using SwingTrail at any time by deleting the App from your device.
By Us
We may terminate or suspend your access immediately if you breach these Terms, we're required to by law, or we discontinue the App.
Effect of Termination
Upon termination, your right to use SwingTrail ceases immediately. Any data stored locally on your device remains under your control.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of SwingTrail after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
14. Dispute Resolution
Informal Resolution
Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us.
Arbitration
Any disputes not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
15. General Provisions
Entire Agreement
These Terms constitute the entire agreement between you and SwingTrail regarding the App.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment
You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
